In the State of Arizona, drivers may be placed out of service for “violating the hours of service rules or for failing to keep a record of duty status.” Likewise, a commercial motor vehicle can be placed out of service “for a mechanical issue.” Motor carriers can also be placed out of service for operating vehicles without the required registration.

If a driver is placed out of service, violating the out-of-service order can result in license revocation.

Under Arizona’s “Mandatory disqualification of commercial driver licenses: definition,” a driver:

  • “Shall not operate a commercial motor vehicle that is subject to an out-of-service order until all repairs required by the out-of-service order have been satisfactorily completed.”
  • “Who is subject to an out-of-service order shall not operate a commercial motor vehicle until the reason for the out-of service order has been remedied.”

Revocation Periods for Violating Out-of-Service Orders in Maricopa County Drivers who violate an OSO in Maricopa County or elsewhere in Arizona face the following consequences

  • First violation of an OSO: CDL revoked for 180 days
  • Second violation of an OSO within a 10-year period: CDL revoked for two years (three years if transporting hazardous materials or driving a vehicle to transport 16 passengers or more)
  • Third or subsequent violation of an OSO within a 10-year-period: CDL revoked for three years (this does not vary if transporting hazardous materials, etc.).
