Punishment for Misdemeanors in Arizona

Class 1

Includes DUI, threatening, disorderly conduct, possession of prescription drugs, aggressive driving, shoplifting, and resisting arrest.

Maximum prison sentence: 6 months

Class 2

Includes reckless driving, consumption by a minor, verbal assault, and criminal damages under $250.

Maximum prison sentence: 4 months.

Class 3

Arizona laws also establish that anyone over 18 or who was tried as an adult and “stands convicted of any misdemeanor or petty offense, other than a traffic offense” and who was convicted of the same offense “within two years next preceding the date of the present offense” will be sentenced “for the next higher class of offense than that for which the person currently is convicted.” So, if you were convicted for trespassing (a class 3 misdemeanor) twice over a period of two years, the second time, you will face class 2 sentencing. This means that you could face four months in jail as opposed to only one.
